My brother has 2 go 2 jail -I'm afraid- he's on the spectrum

OK, I WAS in court, or posted "bail" or settled, 4 times! I admit it! The reasons?
1. Some jerk cited me for supposedly going through a "pedestrian tunnel" that was never used by others, and signs weren't posted. He was about a block away when I came out. I went to court, and forget the outcome. It was less than $100.
2. Some idiot cited me for making an "illegal" left turn. It was from the left turn lane, with the light, safe and legal. Unfortunately, it was 7:03 and there was a tiny sign across the street saying no left turns after 7:00! I simply paid "bail"(aka the fine). It was less than $100.
3. Another jerk was behind me going at the speed of traffic, like I was, and cited me for speeding! His comment when he left? "Make sure you are going FAST enough when you get back into traffic." NOPE, I am NOT kidding! He cited me for something he asked me to do before he left! I paid "bail"(aka the fine). It was less than $100. BTW, today it is legal to go that fast.
4. ANOTHER jerk ran his company into bankruptcy (He asked me to help him start it, and I DID! He went national before the first store broke even, and went bankrupt almost the moment it did! BTW he stole the assets and gave them to a large ISP and became an executive there! I wonder why.(sarc) ) and then sued me for "preference" because he owed ME money! AGAIN, NO JOKE!(They got me at the worst time. I was across the country, etc... If I had still been in california, with my records, I would have won. I appealed to the judges sense of honor and justice, but he wouldn't hear of it. I settled for about 80%. It was about $4000.)
I agree. There are a LOT of comedies here where they have neighbors accuse others of growing pot, etc... In most cases, it turns out to be another type of plant. There is a comedy now called "weeds"! Guess what IT is about!!
Anyways though, I've never done hard time and have always feared it because of my disability.
He can still get charged there for crimes he commits there. Which is where his problems will stem from. If he kills someone upon harrasment to end the threat for instance. If he is approached with gang rape and starts snapping necks as a reflex to end the threat.
If he starts busting knees at hello to avoid having to choose a group.

In the old days we used to have individual cells/cages and things were not so social. They called this inhumane. I call it humane.
Ya i totally would rather be locked away in a seperate cell without any human contact then be put in general population like today because I know if I ever have to go to prison I absolutly will never make it out alive so I am a good boy.

DX'ed with HFA as a child. However this was in 1987 and I am certain had I been DX'ed a few years later I would have been DX'ed with AS instead.
3 years in prison for the victimless crime of growing pot for personal use? There is something seriously wrong with that. I don't think it should even be considered a crime.
I'd try to get a plea bargin and have it include that time should be served in a county jail if he can't get probation and community service. From what I've heard, the county jail is much better than a state prison. Also he's gonna wanna make friends with someone in the jail so people don't take advantage of him.
I have not been to prison but it is more out of good luck than anything. I have never been in to pot or anything but I do have an extremely volatile temper and could have easily gotten me into a lot of trouble with the law if I was pushed.
One nasty incident happened when I was working at mobile home factory which was a place of some pretty tough blue collar factory workers. They often were into so called initiations where new workers had glue poured over their genitals to be considered one of the gang. I did not take to this kindly at all and my temper just simply exploded. First reaction was to grab nearest length of timber, which just happened to be length of heavy roof beam pine to be used on a prefabricated mobile home. It was tapered to a sharp point and was two and a half meters long. I grabbed the thick end and aimed it at one of my tormentors heads like a spear. He just flicked his head to one side as the pointed beam speared past him and missed him by inches. If it connected with his head there would have been more likely than not, fatal. I speared it with such force to tip on the end of the beam shattered into splinters as hit the wall behind him. I would have gotten myself into a lot of trouble and I would have had no sympathy for the ones behind those childish pranks of initiation; even if I happen to kill one of them.
I'd really like to think that he would be kept away from the murderers, rapists and other violent offenders.. He had under 100 plants for himself and his friends... what a nightmare though... sad.. The house behind his unbelievably, was part of a big investigation and he didn't even know the people... They found lots of plants there and his garden was right next door and apparently the dogs discovered it..
He's never had to do any time of jail time, although once he had a problem with DUI and
paraphenalia (Sp?) but never had to do any jail time before... It looks like in the state, the minimum manadatory sentence is something like 2-3 years for the amount of
plants he had : ( Although, it could have been much worse.. some states have sentences of 10 years! or if he had more plants, it would have been alot worse too.. Although with a minimum mandatory, the judge could give more -- that's where the law and justice system can get murky.. (I hate this expression and it shouldn't even be possible, but it might depend on "what the Judge had for breakfast that morning", or what his mood is... I hate that fact about the "justice" systems)
I'm just trying to find out some answers and not dwell on it too much right now, it's haunting..
Before I know it, I'm thinking of him when he was only 5 years old, or thinking of our good
times together, like I'm somehow mourning the loss of him-- Maybe it won't be as bad as

could injure someone and then there's more charges and more possible jail time? that
could be a horrible cycle... anyway, I appreciate your ideas on this...
In a civilized society, prison would reform, not punish. People should be reformed so they don't want to commit crime, not because of fear of prison. Fear of prison isn't a deterrent for the worst of them, anyway. If they're not capable of being reformed, then they should be locked up indefinitely. Also, and obviously, proper psychiatric services should be available for those who need them.
Music maker i completely understand the fact of not knowing what is going to happen to you when you get thrown in the system... I had anxiety attackas like no other while i was in jail... worst thing to feel ever, and i get nightmares about that s**t sometimes.

I can't imagine having to go there myself... People coming up probably trying to bully or get a reaction, and I wouldn't know how to respond to them.. If they tried to grab me though, I think I'd fight back with everything.. but sometimes, there's too many one person could ever fight off.... That's what I fear.. almost like, no one could defend themselves in that type of situation, and if they just wanted to teach me a lesson (not knowing I'm on the spectrum, and just probably didn't even understand what they were saying or didn't respond right...)... that would be my worst fear.. OR loosing my temper and doing something horrible that I could get in alot of trouble for.. Knowing how I am, makes me fear for my brother..
I've never been in prison and probably would find just having to take a shower with strangers difficult (I feel awkward in those situations)... it's hard to keep up a "tough front" like that too... The type of abuse that could go on there would probably be beyond imagination.. I've heard that the guards can even be worse that the inmates sometimes...

Musicmaker if his offense was growing pot and he has never been in trouble before he may probably go to a minimum security facility if he goes to prison. Violent offenders are not sent to a minimum security facility.

I left home when my little brother was only 5 years old.. so much has happened in his life that i don't even know about... Apparently, over 10 years ago, he was charged with assault but it was in self-defense and I don't know if the charges were dismissed or not.. The person was given a concussion but was o.k. otherwise... The only other crimes were drug paraphenalia (possibly twice?) with a DUI... he's far from perfect.. I didn't really have much to say in his choices in life and the times I did try to convince him to change, he would get defensive and say it was his medicine... I guess this was bound to happen... My mother doesn't want to talk about it with me, it depresses and overloads her.. I think she may have paid money for his attorney and doesn't want me to know.. I'm concerned about her being able to care for herself in retirement now... I live over 500 miles away from all of this at the moment... and lived on my own away from them for 20 years... and had only recently come back to try and get to know the family I never really knew.. It's been a nightmare in many ways.. and that's why I moved out of state... He never would listen to me.. but I just don't want him to suffer undue cruelty either...

Once you go into the prison system; stay quiet. Look no one in the eye and do not give any personal information. If you keep to yourself you will be ignored. Look as tough as possible; hardly ever smile. I have learned this from a friend who understands this for a fact. A person can defend himself if he puts up a facade of passivity to get everyone's guard down and suddenly defends himself with a homemade shank. If you know the locations of the aorta and the jugular veins, you can be one of the most dangerous men in the system, as most are as dumb as a sack of bricks. Study anatomy and physiology and learn the common pressure points; it can come in handy. If there are too many after you, run. Never fight a fight you have no chance of winning. The best time to get revenge is when a person is vulnerable, preferably alone or asleep. Use every situation to your advantage.

My dad is a pepper fanatic, so we were growing peppers indoors part of the year under grow-lamps and stuff to make it better for them other times, or something like that. I don't know a lot about growing plants. But anyway, we had them indoors. And someone came in and insisted he could see pot plants there. And they just weren't there.
Just because we had a sign on the door saying "Pepperland" didn't make us potheads, we were just Beatles fans.
But even if we were growing pot or something, so what? I really don't think drugs, even the worst and most harmful ones, should be illegal, because when they're illegal it just creates a massive outlaw industry and hurts everyone for nothing. Then there are people doing real wrong in this country and nobody gives a crap. And I don't even do illegal drugs anymore. (Used to, no interest now.) I know and have seen the kind of harm addiction does, but I don't think this is the solution to it.

I recommend that he gets a good attorney who is familiar with autism. A diagnosis like that can be a mitigating factor in his case. He would need a neuropysch evaluation and expert testimony from a psychologist. To find a lawyer familiar with autism in his area, I would check local autism groups. I've gotten good referrals from people in my area on a variety of services. Good luck.
I just read where there was a study done in the 70's that said of the 47 million people in prison, approximately 10 million of them would end up getting raped?? Is that possible??? Does that sound at all plausible to you all? I haven't really talked to any men that have been in prison, so I don't know... I'm hoping it's an exaggeration .. I've seen that happen in movies though and prison looks so tough and for someone with a learning disability, it could be real hell --
My 1/2 brother has long hair he wears in a pony tail and he's a good-looking guy.. I hope I'm being over-concerned about rape and HIV. He can also be like a "know-it-all" sometimes, but hopefully that attitude will not show itself in prison... I don't think they allow condoms in prison either, so there's no safe sex?? I'm just really worried after reading that report == maybe thing's are better now as opposed to the 70's?? My brother's crime was not violent (apparently he was charged with cultivating and trafficking but he said it was mostly for just him and his friends). However, some people have told me they put everybody in together.. the pot dealers ... in with the rapists and murderers I wish I knew one way or another.. He has to do a mandatory minimum of at least 3 years... probably more...
