So true. Wonder if this case will lead to more people coming forward to report discrimination in the workplace/employment denial because of AS. Show employers what can happen if they do.

Unfortunately the attitude of bosses is that if they can't fire someone because of their autism then all tthey have to do is find another reason to fire the worker.

I plan to someday start a company and only hire people with AS and HFA.

Over the 23 years of working at different jobs these are the following reasons people have been fired for. Some of the people were only accused of these things they really did not do them in some cases.

1) Being late one time
2) Not getting their time on the time card centered right
3) Not putting a pencil they borrowed back on someone's desk
4) Sloppy apperance
5) Bad body odor
6) Constant farting
7) Too many calls from wife/girlfriend/kids
8 ) Always on cell phone when in the toilet
9) Using too much profanity
10) My boss asked me to start an arguement with a guy in front of the boss. The guy called me a ret*d so the boss fired him because I was in special education in high school.
11) Keeping a constantly sloppy work area
12)"Creating a Dangerous" work environment
13) For being a slow worker
14) For being too talkative
15) Taking too many bathroom breaks
16) Starting unfounded rumors
17) Bring pornography to work (The boss had 250 porn videos on his computer I gave them to him so I know)
18 ) For throwing things
19) The use of racial slur (I saw a black guy fired for calling a Latino a Guido, Guido is not a latin racial slur  but he said it)
20) Constantly dropping power tools
21) Kicking a door open when the bosses brother told him to.

If they want you out they can get a "witness" to volunteer what he saw you do or what the boss told him what he saw you do so your screwed.

Things I have done to people in front of the bosses should have gotten me fired. I was a good worker who was never late I also did extra work that I was not trained for but would have gotten me higher pay at another job. I also was able to find free pirated software for the cnc computers we used also I was the boss' main source for music and porn.

1) I have put expanding foam in a guy's tool box our boss just about peed his pants on that one
2) I beamed a guy in the face with an empty water bottle because the boss asked me to keep him off his cellphone. The guy was texting so I popped him
3) Squirted someone in the groin with coolant when he was smoking by the back door where we had flamible aluminum dust stored. Everyone said I should have shot him in the face with it. We had a guy accidently burn down the finishing dept that way. It was very exciting.
4) I put an obscene cardboard sign over someone's liscense plate for messing with me he complained and he got fired
5) I rolled someone's driver's side car window down when it was raining then waited for it to pour to tell him his window was down. He had to run across our parking lot in the pouring rain (He ate my butter finger bar) The bosses did not like him so he was fare game.

Anywhere else I would have beem canned but at the machine shop I was needed and liked. I got picked on a lot but they still liked me. We had guys gert fired but the employees liked him so the bosses hired him back. If a new guy was not fitting in or doing a good job the bosses did not like firing someone but they did like for people to get mad and quit. The bosses admitted to me they prefered me to make them quit because I was not married in case they did have to fire me (They fired me once and had me back the following Monday) and I was in special education classes in school so they could say I did not know any better but they were planning to keep me from doing it again.

Your company will be a drop in the bucket as far as helping autistics. As long as autistics are a minority they will be discriminated against.

1) Being late one time

Someone probably didn't like them.

Valid reason.

Very valid reason.

Todesking wrote:
7) Too many calls from wife/girlfriend/kids

Valid reason unless family emergency.

Todesking wrote:
8 ) Always on cell phone when in the toilet

I don't really understand why people care about others talking on the cellphone in the bathroom but apparently it really bothers some people....I wonder if it's just an NT thing or if there are people with AS who take issue with this.

Valid reason.

Dishonest.

Todesking wrote:

Unfortunately, why I don't think it should matter unless others need to find things on your desk to do their job, this is considered a valid reason.

Valid reason.

Todesking wrote:
13) For being a slow worker

Unfortunately this is a valid reason to fire someone. My cousin fired someone for this despite my attempts to talk her out of this. I proposed the person simply needed more time to acclimate to the position but she was upset that she had to do twice the workload because of it.

Todesking wrote:
14) For being too talkative

Valid reason.

This might be an invalid reason if the person had a medical condition, provided they were still getting their work done.

Valid reason.

Todesking wrote:

Hypocritical but it should be valid to fire someone for bringing porn to work.

Valid reason.

Guido is an Italian name is it not?

The bosses brother wasn't his boss.

As you point out, unfortunately getting an maintaining employment is really a matter of how much one is liked and how well one fits in. I will say there are some exceptions to this.

I sympathize with this guy I lost out on a dream job being a music teacher about a year ago... to a guy who was much less qualified than me. I had a degree in music plus 15 years of music playing experience and the guy I lost to had 6 years of music playing experience and no degree. I was recently told by my friend who works there that the guy they hired got a DUI, unbelievable... I just don't know what to make of this situation

1. I was fired for being late one time.
(Unreasonable but a good excuse to fire an autistic person.)
2.I was fired for asking to be paid the hours on your time card.
(Unreasonable but a good excuse to fire an autistic person.)
3.Fired for returning the company pen I left in my pocket the nest day'
(Unreasonable except for autistics.)
4.Fired for sloppy appearance.
(Hypocritical because I work construction.)
5. Bad body odor.
(I shower every day but I guess thats not good enough if you are autistic.)
6. Belching.
(Usually people find this funny unless you are autistic.)
7. one too many urgent cell phone calls.
(I bet neurotypicals can use the cell phone ten times as much before they get fired.)
8. Rare use of a swear word.
(Hypocritical because I cuss less than anyone else.)
10. Arguing at work.
( When I got called into the bosses office for arguing my Boss told me not to argue but nevertheless he told me how I could win the argument.)
11. Forgetting to put the trash liner back into the trash can.
(Chicken poo reason.)
12. Being a danger at work.
(I don't know if it has to do with violating safety rules or being considered a psychopath because of autism.
13. For being a slow worker.
(Autistics are always praised for being able to pass the drug test and now they want me too take methamphetamine).
14.For being too talkative.
(Yes they hated my big speeches at the monthly meetings.)
15. Taking too many bathroom breaks.
( I drank a gallon of water so I could take the drug test faster because on my last job they fired me for taking too much time at the drug test.
16. Layoff rumors.
( I got my partner fired for spreading his layoff rumor.)
17. Sexual Harrassment.
(Many autistics are perfect gentlemen and treat woman with far more respect than their peers but social akwardness makes them easy targets for unfounded sexual harassment complaints.)
19. Racial slurs.
(Its okay to say that autism is a disease but if you say autistics are geniuses then you are a racist.
19. Constantly damaging power tools.
(Just bad luck I had one day but everyone knows that autistics are not aware.)
20. When autistically unaware and forgetting to knock I opened the door and saw a woman dressing but that was an accident. ( But somehow its okay if she deliberately walks in the Mens bathroom and peeks at me because she thought it was funny.)
20.

I recall seeing a while back here about posts on talking on cell phones. Members here have also said they are bothered by people using them too. It's blue tooth users that bother me. I don't know why but I had it when people use them. It's just annoying when I see someone talking to themselves and it turns out they are on the phone. I don't know why it annoys me, it just does. I get annoyed when my husband uses it and he goes "Sorry I was talking to my brother." Well that is why I hate them.

Also about talking on a cellphone in a bathroom, I think it's rude to go in the restroom just to talk on the phone because you wanted privacy. Wouldn't you be pissed if you were waiting for the restroom for twenty minutes and it turned out it was occupied by a cell phone user? It be different if he was using the jon than just being in there just to talk on the phone.

Quote:
According to an EEOC press release about the suit:

Based on his qualifications for the lab technician position he sought, Randstad had originally fast-tracked O'Dell's participation in the hiring process. While completing Randstad's hiring paperwork, however, O'Dell disclosed the disability. Soon after, he was told that the lab technician position had been put "on hold." O'Dell was not hired and Randstad continued to recruit and hire for the lab technician position.

The suit (Case No. 1:11-cv-01303-WDQ), which was filed last month, charges that the Frederick, MD company violated the federal Americans With Disabilities Act (ADA) act, which makes it unlawful for anyone to discriminate against someone on the basis of their disability. The EEOC first sought to reach a pre-litigation settlement with Randstad through its conciliation process. On behalf of O'Dell, the suit sought "monetary and injunctive relief, including back wages, compensatory and punitive damages as well as employment policies to eliminate future discrimination because of disability." Explaining why the EEOC took up O'Dell's case, Regional Attorney Debra M. Lawrence says:

"We brought this lawsuit because of Randstad's dismissive treatment of Mr. O'Dell based on its apparent presumptions about individuals with disabilities and their ability to be productive employees. It is exactly this type of prejudicial and stereotypical decision making that the ADA aims to eradicate."

Exactly, and I hope employers and their agencies take notice ... but I suspect they will only be more careful and subtle about how they categorically reject someone the next time.
