This Autistic Student Got Two Title IX Violations for a 'Fist-Bump' and a Selfie. Now, He's Suing.

Marcus Knight, an autistic student with cerebral palsy, is suing Saddleback College after he alleges that his college record was "improperly" black-marked with two Title IX violations.

Knight, 19, first came to national attention in 2018 when his attempts to make friends landed him in the Title IX office. According to the lawsuit, Knight asked one female student for a "fist-bump." Soon after, Knight asked to take a selfie with another student.

The "fist-bump" was reported to the Title IX office. And the selfie? When Marcus took it, he accidentally pressed "burst" mode a few times due to his cerebral palsy. The result? Knight had quite a few selfies with the woman, but she later alleged that Knight took "over 300" photos of her.

Knight's mother spoke with PJ Media on Tuesday, explaining that "fist-bumps" and selfies are ways that Knight develops a sense of belonging at college. "My son just wants to have friends like everyone else ... why is that wrong?" ....

While Knight hopes to graduate with a B.A. in musical theater, because of the accusations made to the Title IX office Knight is no longer allowed to be on campus, in class, or in any activities without the oversight of his mother or a special-needs aid.

Some positive news for a change.


EXCLUSIVE: Autistic college student clears name after frivolous allegations

Marcus Knight—a student with autism, cerebral palsy, and learning disabilities—has prevailed in his lawsuit against Saddleback College, according to exclusive documents obtained this Sunday by TPM.

After being accused of sexual misconduct, Knight filed the lawsuit to clear his name.

Knight first came to national attention in 2018 after his attempts to make friends landed him in his college’s office for sexual misconduct (also known as a Title IX office). As a young man with autism, making friends has always been difficult for him, he told me.

One female student reported him because she was uncomfortable with Knight asking for fist-bumps, one of the “safe ways” he was taught to make friends, his mother said. Another student claimed Knight was looking at her weird and following her around campus.

Some people really hate people with autism. We have to remain aware of that & not sugarcoat these realities with dismissals relating to awareness & "safe spaces". This was literally a misCLICK. Perhaps everyone involved was uncomfortable. People with autism are rarely comfortable anyway, as far as I'm concerned, NTs can cry us a river about who's less comfortable.

I'm not intent on complaining more here, though I can't stress enough that we need to be cautious about unchecked hatred masquerading as a social justice concern in the interest of NTs. We're gonna act weird, it's just a way of being & a matter of fact. It's on everyone to get along & we don't need lawsuits to do that either. I think everyone was overreacting to this guy's ASD in the first place, including him when he was taking 'selfies'.

Selfies tend to offend my sensibilities anyway, so I get where they're both coming from. I don't want to be in anyone's selfies & I don't owe anyone an explanation for my camera-shyness.

I suffer no delusions that anyone in the world is actually tolerant of the way my brain works or doesn't work. This is why I stay away from people.

Well it was good news last month (see above), because the court ruled in favor of the autistic student. But now the college is appealing the ruling.


CONFIRMED: College Will Appeal Ruling That Favored Autistic Student Punished For Fist Bumps And Selfies

The southern California community college that punished an autistic student for trying to make friends by offering “fist bumps” and asking to take “selfies” has officially filed a notice of appeal after a court ruled the school needed to remove the negative marks from the student’s transcript.

The student at the center of the case is Marcus Knight, who has autism, cerebral palsy, and a shunt in his brain to relieve fluid pressure. Knight and his mother, Aurora, have fought his entire life for him to be treated like everyone else. He had been taught at a young age that he could try to make friends by offering fist bumps, and that asking people to take selfies with him would be inoffensive, since Marcus has difficulty making friends due to his disabilities.

While enrolled at Saddleback College, however, these simple and inoffensive gestures left Marcus with sexual misconduct marks on his permanent record.

I think cberg has it nailed here. This had nothing to do with sexism or title ix. It was NTs being weirded out by someone who is "other." I'm not sure if it was the autism or the cp, though.

I spend a lot of time with people with cp, autism, Down syndrome, etc. in the community. Autists are not the only ones shunned.

When I lived in town, I walked around on the streets and sidewalks. It was a safe and comfortable neighborhood. A man with Down syndrome was riding his bike and stopped to talk to me. We were walking along and another man stopped and asked me if I was okay, clearly worried that the Down syndrome man was "bothering" me. This in spite of us talking and laughing. And this is Down syndrome, usually considered the "cute" disability. "Are you sure," he said. :roll:

Luckily, in this case, my Down syndrome friend was totally unaware of the slight. Most autists would not be so unaware.
