I am so sorry to hear about this. I am going through a similar problem right now. My son is 12 and he had such a terrible time this last year (6th grade). The school refused to believe that he had a true problem and wasn't just being noncompliant. We fought tooth and nail all year to get him help. They even restrained him right before Christmas because he wanted to finish a test and refused to get up and leave the classroom.

We had a 3 hour IEP meeting the last week of school that ended in disagreement. We had requested an AU eval. They said he had all the behavioral characteristics of Aspergers, but that they couldn't rule out that they were caused by school anxiety and depression instead. I actually work for the school district as an Elementary ARD facilitator. At the May IEP, they decided that my son who is dyslexic and was reading at a 2nd grade level at the beginning of the year but has progressed to an 11th grade reading level is no longer Learning Disabled and no longer needs any Assistive technology or special help. They refused to limit his school day or allow for some of the behavioral accomodations we were asking for. I was bound and determined that I was going to transfer him, but his SpED counselor convinced me that it wouldn't be good for him.

Then a week ago, I got a letter from his principal (who has no kids and has no heart) telling me that she was revoking his transfer (He was a transfer student already at this school). Her reason for revoking it was because "the staff feels that the parents should attempt to work with his home campus in meeting his needs." So, basically they are revoking his transfer simply because he is special needs and they don't like me forcing them to do what they are supposed to do.

I have a meeting with the superintendent tomorrow. I have already decided to homeschool him next year, not that I will tell them that. I just have to figure out how to make it work b/c I'm going to be teaching General Ed 4th grade next year. I can't leave him at home alone and my hubby gets home around noon each day. I'm going to try to get them to allow him to do community service at my school during the day and homeschool him at night and on weekends. :)
