I have medical guardianship due to doctors falsely claiming I am incapacitated and unable to make medical decisions. I recently went to another doctor to test to see if I’m capable of making medical decisions and they said I can. So my other psychologist made me worse then I am and falsely said I’m incapacitated and unable to make medical decisions treating me like a vegetable and they ignore what I have to say and talks to my mom instead which is scary and wrong. I passed the capacity evaluation test by another professional doctor and able to make medical decisions. I'm starting to argue that the guardianship isn't necessary because I can answer capacity questions correctly. I can describe the condition, the recommended medication, the main risks (side effects), the expected benefit (improvement), the alternative (therapy), and what happens if you do nothing (worsening). That meets the understanding requirement. I accept that the diagnosis applies to me, I recognize that refusing treatment would harm me, and I understand the doctor is recommending the medication to help me get better. I state what you want to do and indicate that the choice is consistent. Also my mother said that she didn’t have to speak to a judge she just had to fill out a form to apply for medical guardianship and she and my therapist said my sex life isn’t affected so I don’t understand why they are so concerned who I have sex with when I know red flags of guys and have gotten better at my judgment. What should I do about this situation now? I will try to get this guardianship revoked as as soon as possible so I can have my rights back! I am not as low functioning as people think. If I was so low functioning I wouldn’t be able to type all this out right now and express myself to fight for my rights. I don’t know who my attorney is because my mother and me didn’t hire one and it’s expensive to hire one. What do you think?
