Lived at home address for 10 years now, for past 8 years subjected to threats, excessive loud music, erratic behaviour, slander, nuisance, disturbance etc. from a bipolar neighbour. Oh and an instance of me witnessing oral sex in broad daylight outside my home.

My housing co-operative and the police, procurator fiscal don't want to take things further.

I have had to come out as being 'Asperger's' hoping to gain some peace and quiet but instead I am told "If the police don't do anything we can't do anything."

The only thing left for me is to obtain a "Non-Harassment Order" so each time I am threatened etc. I will have to call the police, give statements etc. etc.

Does anyone else have a similar situation where basically they are told "HE has issues - so do YOU." ?

Thank goodness I'm not currently in that situation and I also have no idea how you should proceed from there but I just wanted to say, I can genuinely sympathize with you. Bad neighbors can make life an absolute living hell and going through that for eight years now...sheesh, you deserve some kind of monetary compensation for psychological damages incurred. It sounds like the non-harassment order is a good route to take despite the work that goes into giving statements and dealing with the police.

Yes. It might help if you could get a doctor to write a letter to the department saying the situation is impacting on your mental health.

Thanks for the replies and support. I can't afford a move as that would involve new floorings etc. I have a 16 year old cat who has access to a great huge grassed area just outside the back garden so it would be unfair moving him to another area as he is very territorial and would end up injured in fights. I have nice neighbours either side who I get on with and a local GP who I like, so moving isn't an option.

Flm themand put them on YouTube is what I suggest. Don't do it with an accompaning nonsesnsical rant like that one woman who screams because cars drive down her street and she has AS, but just film the redneck behavior and post it on a YouTube station called something like "Neighbors From Hell". No commentary, just let the video speak for itself.

I have an appointment with a lawyer on Thursday, hopefully it will soon be a matter for the police to deal with after then.

I feel more positive and thank everyone who has given advice [even though some of it is illegal in this country]. :lol:

The meeting with the lawyer was a tad depressing. :(

The trouble I have is not being able to corroborate my neighbours actions against me. I have no witnesses as I live alone AND CCTV cannot be used as evidence. Neither can his statements of admitting guilt and asking me to forgive his actions.

From Wiki: The importance of corroboration is a unique feature of Scots criminal law. A cornerstone of Scots law, the requirement for corroborating evidence means at least two different and independent sources of evidence are required in support of each crucial fact before a defendant can be convicted of a crime. This means, for example, that an admission of guilt by the accused is insufficient evidence to convict in Scotland, because that evidence needs to be corroborated by another source.

Would it work if you had someone else stay with you for a while and have them back up your story?

Yes. The problem it seems is I need witnesses [2] for this purpose.

It is very difficult involving neutral neighbours, I wouldn't want to do that. I may have to do as you suggest and bring in witnesses but then I expect I would have to bring them back to witness him breaking a court order. What a carry on!
