Yes, that's ACLU territory. Such a comment can have a chilling effect on the free speech not only of the lady victim in this case, but on others who might want to make comments in the future but stay away due to the racism. The ACLU specializes in cases where government action impinges on the rights of citizens to speak freely and without intimidation, so yes, this is a good example of what the ACLU is and does.

At most they could have opined that this was not protected speech, it was intimidation etc. Personally as yes deplorable as that statement was I don’t see how it is more intimidating then marching with Nazi flags in a neighborhood of holocaust survivors which they famously defended. They were arguing the courts a branch of the government should allow it which they did.
