it wouldn't be legal. if a party is under duress, especially like that, the contract is voided. it's not considered consensual.

Are you sure about that skafather?
It turns out that there are contracts that prisoners have drafted that include prison marriages but they are not legally binding because naturally the state refuses to recongnize them. But in some cases the prison administration grants unofficial recgonition.

Married cops can't serve as partners, or sometimes even in the same precinct. Why should prisoners get special priviledges?

Because prison rape is deliberately condoned by the prison guards because it serves as a means of maintaining order in overcrowded jails and state prisons.

1. unofficial recognition doesn't mean squat. it means the guards are playing pretend and acting like they hold some kind of power. more of a sick reminder of the stanford prison experiment than anything else

2. again, see the point about a contract made under duress...it's a void contract if such a scenario occurs. this is because for a contract to be made, both parties must be entering the contract of their own free will.

3. what are the rights given up when one becomes a prisoner? does that include contractual rights? i don't know about this but it seems like an area where other roadblocks could come up in not allowing contracts.

Our oldest son is a correctional officer:
Correctional officers cannot be related to any inmate. The inmate is transfered to another facility.
Related inmates cannot be in the same facility- I can only assume that would apply to same-sex married inmates as well.

Why is this an issue? It happens to establish a social hierarchy in prison, and also according to maslow's hierarchy of needs, people have a need for sex. If they are unable to get it from the opposite sex, then they'll turn to the same sex.
In the case of homosexuality, the same-sex is already established in prison. But it might cause an anxiety about having sex in prison. I have a hard time explaining this... but there should be no controversy about this. It is human nature, it doesn't change (it is what it is.)

I always thought that by doing a crime, you are revoked or your privilege to rights by being sent to jail.

I don't think prisoners should have the right to vote, but thats a whole different topic altogether.
