I think they do... And unless a transgendered male flashed someone in the female toilet, I don't see how the penis could become an issue. And I really don't think that most transgendered people go into the bathroom to that - they go there to pee!

Police don't do anything unless there is a disturbance. And generally, only idiots would cause a disturbance in the bathroom. >.>;

I avoid public restrooms all together and wait till I get home but then again my anxiety doesn't keep me out long.
Also I avoid them also because they are rarely very clean and gross me out. LOL

So I avoid the entire issue and thus for me there is no issue.
But in general, I think gender neutral bathrooms should be the way to go, a main "powder" area where men and women can share (and should not be naked or be illegal to be naked in, heck place cameras in that part) and have fully floor to cieling closed off larger sized stalls, problem solved!

We should be in an era where gender should be less of an issue stereo-typically in such cases and as always other solutions such as the one I mentioned above are overlooked or refused to be considered because people don't grow up and get their minds out of the gutter.

Arrested for what? I've seen people use the opposite gender bathroom if the other was busy. It's not illegal to go in the wrong bathroom, unless maybe you just went in there to peek at people or other pervy reasons.

I'm a girl but I have went in the men's room if whoever was in the ladies was camped out.
But it was always a single stall.
If you have to go bad enough you have the right to use any bathroom.
I don't really care who uses what facility as long as they don't make a mess.

Not a lot I can say to a comment I made six years ago but for what its worth I'd figure this as a regional issue - ie. in a multiperson bathroom there'd likely be some trouble at least in the midwest and many places that are less used to such occurrences.

Transgender toilets. Yeah girls just love having guys hear them take a screaming dump.
Could yo imagine the smalltalk it could inspire?
Guy and girl wash their hands after using stalls, compare the smell of each others turds. Mmmm. :roll:

If they pass no one would know the difference and if they don't quite pass in many cases people may just think that they are a feminine looking man or a masculine looking woman.

Sometimes people call my mother sir but as far as I know no one ever hassled her or gave her funny looks for using the women's bathroom.

Peeking doesn't even seem like a reasonable problem to consider, in a way, since gay people could do that too...

Depends where you live. Laws vary. It is illegal in Florida and the law specifically states transgenders can not use public restrooms period if they come across as the opposite sex, but that's the state of extremism aka Florida. Not sure if the law stuck however, I never heard it get repealed. All I know is some stores who have more respect there have created unisex bathrooms that trans folk can use. I also heard it is illegal in Texas as long as you are legally recognized as the opposite sex, so if you pass 100% as female but on your license are male in Texas I believe it was a minor felony sex crime.

So yeah, never think just because where you live it's legal means it is everywhere when these types of laws can vary on the city level let alone county and state. Be sure first, google it, most states have their laws online now.

The one that identifies with the Gender they were born as. If they were born as a male, use the male bathroom.

But they can't if they pass. If they look female or are close enough and are obviously dressed as a female they would likely run into more trouble using the men's room than the woman's room. In the woman's room people would think they are a woman or a slightly masculine looking woman and not say anything. In the men's room it's likely the men would have a fit if a person in a dress walked in whether they passed or not.
